ফৌজদারি মামলার নিষ্পত্তি পর্যন্ত ধাপ সমুহঃ
ফৌজদারি মামলার ক্ষেত্রে কোন অভিযোগ আমলে নেওয়া হলে মামলা নিষ্পত্তি পর্যন্ত যে কয়টি ধাপ রয়েছে তা পর্যায়ক্রমে দেয়া হল (প্রাথমিক ধারনা, বিস্তারিত না)
★সমন:
আসামী দের বিরুদ্ধে আদালত স্বাক্ষরিত সমন ইস্যু করা হয়। যেখানে আদালতে হাজির হবার জন্য একটি নির্দিষ্ট তারিখ থাকে।
★ওয়ারেন্ট:
সমনে উল্লেখিত তারিখে আসামী হাজির না হলে আদালত তার বিরুদ্ধে ওয়ারেন্ট ইস্যু করেন। এরূপ প্রসেস কে W/A বা Warrant of Arrest বলা হয়।
WP & A:
ওয়ারেন্ট এ উল্লেখিত তারিখে আসামীকে হাজির করা না গেলে বা আসামী পলাতক থাকলে আদালত তার বিরুদ্ধে WP & A (Warrant of Proclamation and Attachment) ইস্যু করেন।এটি ‘হুলিয়া’ বলে পরিচিত।
পত্রিকা বিজ্ঞপ্তি:
WP&A এতে উল্লেখিত তারিখে আসামীকে হাজির করা না গেলে বা আসামী পলাতক থাকলে এবং আদালত তার বিরুদ্ধে দুটি বহুল প্রচলিত বাংলা পত্রিকায় বিজ্ঞপ্তি প্রদানের আদেশ দেন।
★অনুপস্থিতিতে বিচার:
পত্রিকায় বিজ্ঞপ্তি প্রদানের পরও উল্লেখিত তারিখে আসামী হাজির না হলে বা আসামী পলাতক থাকলে তার অনুপস্থিতিতে বিচার শুরু হয়। একে আইনের ভাষায় (Trial In Absentia) বলে।
★চার্জ শুনানী:
উপরোক্ত কোন প্রক্রিয়ায় বা স্বেচ্ছায় অভিযুক্ত ব্যক্তি হাজির হলে আদালত তাদের উপর আনীত অভিযোগ তাদেরকে পড়ে শোনাবেন। তাদের বিরূদ্ধে আনীত অভিযোগের সত্যতা স্বীকার করলে আদালত তার জন্য তাদের কে শাস্তি প্রদান করবেন। অভিযোগের সত্যতা অস্বীকার করলে উহার সত্যতা নিরূপনের জন্য সাক্ষীদের সাক্ষ্য গ্রহনের নিমিত্তে সাক্ষীদের প্রতি সমন এবং ক্ষেত্র বিশেষে অন্যান্য প্রসেস যেমন: WW বা witness warrant এবং NWW বা Non Bailable Witness Warrant ইস্যু করা হয়।
তবে চার্জ শুনানীতে যদি আদালতের নিকট প্রতীয়মান হয় যে, আসামীদের বিরূদ্ধে আনীত অভিযোগের প্রাথমিক সত্যতা নাই তাহলে বিচারে না গিয়ে আসামী/আসামীদের কে অব্যাহতি দেয়া হয়।
★সাক্ষ্য গ্রহন:
এই পর্যায়ে ফরিয়াদী পক্ষের আইনজীবী ফরিয়াদী সহ তার মনোনীত সাক্ষীদের জবানবন্দী গ্রহন করেন এবং আসামী পক্ষ তাদের জেরা করেন। সাক্ষীদের সাক্ষ্য গ্রহন সমাপ্ত হলে আদালত উভয় পক্ষের আইনজীবীদের যুক্তিতর্ক শ্রবণ পূর্বক রায় ঘোষনার জন্য তারিখ ঘোষনা করেন।
★রায় প্রদান:
সাক্ষীদের সাক্ষ্য, নথিস্থ কাগজাত ও অনান্য পারিপার্শ্বিক অবস্থা বিশ্লেষন করে আদালতের নিকট সন্দেহাতীত ভাবে আসামীদেরে বিরূদ্ধে আনীত অভিযোগ প্রমাণিত হলে আইনানুসারে শাস্তি প্রদান করেন কিন্তু অভিযোগ প্রমাণিত না হলে খালাস প্রদান করেন।
★আপীল:
কোন পক্ষ আদালতের প্রদত্ত রায়ে সন্তুষ্ট না হলে এখতিয়ার সম্পন্ন উচ্চ আদালতে আপীল করতে পারেন।

সোহরাব ও রোস্তম ঃ

চন্দ্রা গ্রামের বাবুর শক্তি ও সাহসিকতার কথা সবার জানা। তাই কেউ কোনো সমস্যায় পড়লে তাকে ডাকা চাই। একদিন রহিমদের ষাঁড়টি ঘর থেকে ছুটে মানুষের ক্ষতি করতে শুরু করল। বাবু একাই সেটিকে বাগিয়ে আনল।
ক) বীর যোদ্ধা শামের পুত্রের নাম কী?
খ) রখ্শ মহানন্দে হ্রেষাধ্বনি করে কেন?
গ) উদ্দীপকের বাবুর মাঝে ‘সোহরাব রোস্তম’ গল্পের যে দিকটি ফুটে উঠেছে তা ব্যাখ্যা করো।
ঘ) উক্ত দিকটি রোস্তম চরিত্রের পূর্ণাঙ্গ পরিচয় নয়—‘সোহরাব রোস্তম’ গল্পের আলোকে বক্তব্যটি বিশ্লেষণ করো।

মার্চেন্ট অব ভেনিস

★ কায়েস ও মামুন দুই ভাই হলেও দুজনের চারিত্রিক বৈশিষ্ট্য ভিন্ন। কায়েস সাধ্যমতো অন্যের উপকার করে, বিপদে পাশে দাঁড়ায়। অন্যদিকে মামুন কী করে ধনী হবে, সে দিকই তার খেয়াল। তাই তো মানুষকে বিপদে ফেলে অর্থ আদায়ে সে দ্বিধা করে না। গ্রামের সবাই কায়েসকে পছন্দ করে আর মামুনকে ঘৃণা করে।

★ মিজান ও সেজান দুই ভাই হলেও তাদের দুজনের চরিত্রের বৈশিষ্ট্য ভিন্ন। মিজান ছোটবেলা থেকেই ভদ্র, পরোপকারী, সহজ-সরল। বন্ধু মহলেও তার খুব সুনাম ছিল। তাই ছোট-বড় সবাই তাকে ভালোবাসে। অন্যদিকে সেজান ছিল চঞ্চল, অহংকারী ও লোভী। তাই সে বড় হয়ে সুদের ব্যবসা করত এবং মানুষ বিপদে পড়লে কখনোই সাহায্য-সহযোগিতা তো করতই না, উপরন্তু অন্যায়ভাবে হেনস্তা করত।

রিপ ভ্যান উইংকল

★ ১৯৭১ সালের মুক্তিযুদ্ধে অসহায় বাঙালি নিজ দেশ ছেড়ে অন্য দেশে আশ্রয় গ্রহণ করতে বাধ্য হয়। স্বাধীনতার পর কেউ কেউ দেশে ফিরে আসে। কিন্তু মতিন মিয়া আর ফিরেনি। ৩০ বছর পর দেশের জন্য নাড়ির টান অনুভব করলে সে দেশে ফিরে আসে। দীর্ঘদিন পর আপনজনদের সান্নিধ্যে তাকে অতীত জীবনে ফিরিয়ে নেয়।

★ আব্দুল আলী খেয়ালি এবং হাস্যরসিক একজন মানুষ। গ্রামের ছোট ছোট ছেলেমেয়েদের সঙ্গে খুব ভাব ছিল। যেকোনো গল্পের আসর সে জমিয়ে রাখত। সংসারে উদাসীনতার কারণে তার স্ত্রী তাকে সব সময় বকাঝকা করত। তাই একদিন সে রাগ করে বনে গেল এবং সেখানে একটা কুঁড়েঘর বানিয়ে বসবাস করতে লাগল। সে প্রতিজ্ঞা করেছে, তার স্ত্রী মারা না যাওয়া পর্যন্ত সে গ্রামে ফিরবে না।
